In December 2016, the Fifth Court of Appeals granted the United States Department of Labor an expedited briefing schedule to file their briefs January 31, 2017 to challenge the injunction issued against enforcing the new overtime rule.
The new overtime rule, released in May, increased the threshold at which executive, administrative, and professional employees were exempted from overtime pay from $23,660 to $47,476.
President-elect Donald Trump takes office on January 20, 2017. Only time will tell if the Department of Labor is told to withdraw its appeal on this issue.
