James D. Schweikert
Partner
James is the coordinator of the firm’s intellectual property practice group focusing on patents, trademarks, copyrights, trade secrets and related litigation. He is well versed in mechanical, electro-mechanical, and electrical arts. James has experience acting as in-house IP counsel to several mid-market clients, reviewing and managing intellectual property portfolios, evaluating technology developments and implementing protection strategies, as well as development and review of non-disclosure, non-competition, and joint development agreements. In addition, James is experienced in intellectual property litigation support including the analysis of legal claims and the drafting of legal briefs and related motions.
Patent Law
James’s experience is extensive in patent preparation and prosecution, and the evaluation of invention disclosures for potential patent protection. He performs U.S. and international clearance searches for patents and renders legal opinions relating to patentability, clearance and infringement of patents worldwide. James also prepares agreements for the assignment, license, and management of patent rights.
Trademark and Copyright Law
James has drafted and prosecuted numerous applications for the registration of trademarks and copyrights, including several mask works. His experience includes performing U.S. and international clearance searches for trademarks and rendering legal opinions relating to trademark registrability, clearance and infringement of trademarks worldwide, including preparation and prosecution of patent and trademark applications. Additionally, he prepares agreements for the assignment, license, and management of trademarks and copyrights.
Committed to his community, James currently serves on the Executive Board for the Boy Scouts of America, Great Trail Council (Previous Chairman for Lakes District); member of the Historic Preservations Commission, City of Green (Past Chairman); member of the Finance Committee for Greensburg United Methodist Church; and a member/legal advisor for the Green Historical Society. His professional memberships include the Federal Bar Association, the Ohio State Bar Association, the Stark County Bar Association, and the Cleveland Intellectual Property Law Association.
